Members should be aware that effective October 6, health-care providers, health IT developers, and health information exchanges and networks must share all electronic health information, with some exceptions for security and privacy.
In other words, the definition of “information blocking” in 45 CFR 171.103 no longer limits what’s considered EHI to the data elements represented in the United States Core Data for Interoperability version 1 (USCDI v1). APMA will update its information blocking resources in the coming weeks. Note that HHS has not determined enforcement mechanisms for possible requirement violations, nor has it established penalties or disincentives.
