  • APMA Defends Mississippi Members Against AMA

    For the past several years, the Center for Professional Advocacy at APMA has collaborated closely with the Mississippi Podiatric Medical Association to modernize the state’s scope of practice to permit podiatric physicians to treat the ankle. Most recently, the CPA submitted a letter to the Mississippi State Legislature supporting MsPMA and refuting a letter from the AMA.

    Representatives Buddy Carter (R-GA) and Lori Trahan (D-MA) sent a letter to the Substance Abuse and Mental Health Services Administration (SAMHSA) on July 13, reaffirming congressional intent and asking that SAMHSA use its authority to approve additional training organizations for new or renewing DEA registrants. SAMHSA responded this week, confirming its refusal to act in spite of this reaffirmed congressional intent.

Alabama Governor Kay Ivey (R) signed Senate Bill 28 into law on May 3, updating podiatrists’ scope to include the ankle. The bill will take effect August 1.

  • APMA Renames Award in Memory of Franklin Kase, DPM

    APMA is deeply saddened by the loss of California member Franklin Kase, DPM. Dr. Kase died in March after a protracted illness. Dr. Kase was extremely active in California and at the national level in podiatry’s payer advocacy efforts. He was instrumental in APMA’s victory with Anthem, where an onerous policy would have significantly cut reimbursements for evaluation and management (E/M) services billed with CPT modifier 25.

  • Abstract Questions Podiatric Surgical Outcomes

    APMA is aware of an abstract presented at the 2021 meeting of the American Orthopaedic Foot and Ankle Society, which compares outcomes of surgery performed by podiatrists and orthopedic surgeons. While the abstract of this study was published in Foot and Ankle Orthopaedics, the paper in its entirety has not been published, nor to our knowledge has it been accepted for publication by a peer-reviewed journal. It has also been pulled from presentation at future meetings due to problems with the study.

    The following alert is offered to provide risk advice to podiatrists. In the past five years, podiatric physicians have seen great patient benefits from the emerging use of amniotic fluid injections to treat musculoskeletal conditions, such as plantar fasciitis and tendonitis. Despite these benefits, the FDA has recently stated that it has not approved the use of such products and that further study is needed. On February 28, all Medicare Administrative Contractors (MACs) announced that they would be denying claims for amniotic fluid injections.

    During the COVID-19 Public Health Emergency and through the end of 2024, there are four main non-face-to-face service types podiatrists can provide. A podiatrist’s ability to employ these services and be reimbursed for these services may differ based on the patient’s insurance and state licensure.     Since last November, APMA has been working with our Novitas Carrier Advisory Committee (CAC) representatives to clarify problematic language in Novitas’ Mycotic Nail Debridement Local Coverage Determination (LCD). As a result of the work of APMA and the CAC representatives, Novitas has changed the language, releasing a new LCD with an effective date of August 16, 2018. Under this new LCD, if the patient qualifies under “mycotic nail debridement” and debridement is performed without concomitant pharmacologic therapy, mycologic confirmation is expected.

    HR 1221/S 626, The Helping Ensure Life- and Limb-Saving Access to Podiatric Physicians (HELLPP) Act, was introduced to the 114th Congress on March 4 by US Sens. Chuck Grassley (R-IA) and Charles Schumer (D-NY) in the Senate and US Reps. Renee Ellmers (R-NC) and Diana DeGette (D-CO) in the House. The bipartisan HELLPP Act includes multiple comprehensive reforms that will enable podiatric physicians to continue to save lives, limbs, and health-care dollars. The net result of implementing these common-sense provisions would be significant improvements to patient access to quality foot and ankle care and tremendous savings for the Medicaid and Medicare programs.

    DME Medicare Administrative Contractors (MAC) published a notice stating that all four jurisdictions would be delaying implementation of recently finalized local coverage determinations (LCD) for pneumatic compression devices (PCDs). The scheduled effective date was November 1. DME MACs have not published a future effective date. These LCDs would have prevented podiatric physicians from prescribing PCDs regardless of the scope of practice in their respective states. The current LCD and related policy article will remain in effect.
